While the Dutch have a well-earned reputation for progressive drug policy, ayahuasca occupies uncertain legal ground. DMT—the primary psychoactive compound in ayahuasca—is classified as a "hard drug" under the Opium Act. Several retreat centres and churches have faced court challenges over the years, and some have paused operations pending legal clarity.

Ayahuasca's Legal Status: The Full Picture
DMT Under the Opium Act
The Netherlands distinguishes between "hard drugs" (Schedule I) and "soft drugs" (Schedule II) under the Opiumwet (Opium Act). Schedule I includes substances considered to present unacceptable risk.
N,N-Dimethyltryptamine (DMT) is explicitly listed in Schedule I—the same category as heroin and cocaine.
Because traditional ayahuasca preparations contain DMT, activities involving ayahuasca—possession, supply, importation—fall within the scope of hard drug regulations.
Court History
Dutch case law has repeatedly addressed ayahuasca's legality:
- Santo Daime cases: The Santo Daime church argued for religious exemption, similar to protections granted in other countries. Dutch courts found that ayahuasca contained DMT (a Schedule I substance), and the European Court of Human Rights ultimately ruled that Dutch authorities had not violated religious freedom by prosecuting these cases.
- 2019 Supreme Court ruling: The Dutch Supreme Court prohibited the importation of ayahuasca, citing public health considerations under the Opium Act.
These rulings establish that ayahuasca is not legally protected in the Netherlands, even in religious contexts.
Current Operating Reality
Despite the legal situation, some ayahuasca ceremonies continue in the Netherlands:
- Some operators use non-DMT formulations: Brewing only the Banisteriopsis caapi vine (which is legal) without DMT-containing admixture plants. This produces a different experience than traditional ayahuasca.
- Some operate in grey areas: Conducting ceremonies discreetly, often with password-protected websites and word-of-mouth distribution.
- Some have paused operations: At least one major operator suspended retreats in both the Netherlands and Spain as a "precautionary measure" pending legal proceedings.
The landscape is unstable. What operates today may not operate tomorrow.
Psilocybin: The Clearly Legal Alternative
If you're seeking a legal psychedelic experience in the Netherlands, psilocybin truffles are the compliant option. Unlike ayahuasca, psilocybin truffles exist in a clear legal framework. Several professional retreat centres (such as Synthesis) offer structured psilocybin experiences legally.

Spain
Several retreat centres operate in Spain, particularly in Catalonia and the Canary Islands. Spanish law doesn't explicitly prohibit ayahuasca in private ceremonial contexts. Many retreats bring in South American facilitators.
Portugal
Portugal's 2001 decriminalisation creates a more permissive environment. Some retreat centres operate here with relative openness.

Travel From the Netherlands to Peru
Visa Requirements
Good news: Dutch passport holders do not need a tourist visa for Peru for stays of 90 days or less.
- On arrival, Peruvian authorities determine the permitted length of stay (this cannot be extended)
- Your passport must be valid for at least six months from your date of entry
Getting There
From the Netherlands, travel typically involves:
- Amsterdam (Schiphol) to Lima
- Approximately 13-14 hours with one connection (often via Madrid, Paris, or a US hub)
- Some seasonal direct flights may be available
- Lima to Iquitos — Domestic flight (approximately 2 hours). Several daily flights.
- Iquitos to the centre — We arrange ground transport to Hummingbird Healing Centre.
Recommendations:
- Consider arriving in Lima a day early to rest and ensure luggage arrives
